These Terms and Conditions of Use ("Terms of Use") govern your use of the psyclehealth.com website, its subdomains, landing pages, social media platforms, media content, and CRM platform, along with the services ("Services") provided on, through, or in relation to these channels. By accessing and using these Services, you agree to be bound by these Terms of Use, which form a legally binding agreement between you and Psycle Health, Inc. ("Psycle Health" or the "Agency"). The terms "you" and "your" refer to you, your dependents, and any other person accessing your account.
Important Notice:
Psycle Health is not a medical provider. Medical appointments obtained through the platforms are facilitated by independent medical practitioners. Psycle Health's role involves connecting users with independent mental health providers in the United States. For specific terms applicable to these providers, reference the section titled "Supplemental Terms Applicable to Mental Health Providers."
Arbitration and Class Action Waiver:
This agreement contains mandatory arbitration provisions and class action waivers requiring individual dispute resolution through binding arbitration. By accepting these Terms of Use, you acknowledge having read and understood these terms.
1. Services Provided – No Medical Care or Advice by Psycle Health
Psycle Health partners with independent Mental Health Providers who deliver clinical services through their own electronic medical record platforms. Psycle Health itself is a separate entity from these providers and does not deliver medical care. Independent providers bear sole responsibility for care quality and appropriateness. Psycle Health does not offer legal advice regarding issues associated with provider services.
2. Relationship Between Psycle Health and Mental Health Providers
Mental Health Providers function as independent contractors using Psycle Health's platform to connect with potential patients. Psycle Health does not own, control, or have any ownership interest in these providers or their clinics. All medical advice originates from providers, not Psycle Health. Provider relationships do not replace existing healthcare practitioner relationships.
3. Emergency Situations
Psycle Health's services are not intended for medical emergencies. If you have a medical emergency, please call 911 immediately. Users should not use these Services for urgent or emergency medical conditions.
4. Telehealth Services
Telehealth services enable healthcare delivery via electronic communication. While telehealth offers convenience, it cannot always substitute for in-person care. Users assume all associated risks.
5. Availability of Services
Psycle Health operates in compliance with state and federal regulations, and Services may not be available in all states. By using Services, you confirm that neither U.S. laws nor relevant jurisdiction laws prohibit your enrollment or receipt of Services.
6. Changes to Terms of Use
Psycle Health may modify these Terms of Use at any time. Changes posted on the Website, Social Media, or CRM become effective upon posting. Continued Service use after modifications constitutes acceptance of updated Terms.
7. Electronic Communications
By using Services, you consent to receiving electronic communications including emails, messages, and other communications sent via desktop or mobile devices.
8. User Eligibility
The Services are only available to users who are 18 years of age or older. Accessing Services represents meeting this age requirement. Personal information collected from individuals under 18 will be promptly deleted.
9. Accuracy of Information
While Psycle Health strives for accuracy, there is no guarantee regarding information accuracy, completeness, or timeliness on platforms. Users should report inaccuracies for correction.
10. Compliance with Law
You agree to comply with all applicable laws when using Services, including laws related to privacy, intellectual property, and data security.
11. Device Functionality
Users bear responsibility for maintaining devices, software, operating systems, and network access necessary for Service use. Psycle Health is not responsible for issues arising from modified or non-compliant devices.
12. Third-Party Liability
Psycle Health is not responsible for the actions of third parties, including your wireless carrier, device manufacturer, or any third-party services used in conjunction with our platforms.
13. Intellectual Property
Psycle Health retains all rights, title, and interest in Services and related intellectual property. Unauthorized use of trademarks, service marks, or logos is prohibited.
14. License to Use
Psycle Health grants a limited, non-exclusive license to access and use publicly available pages and content, subject to these Terms of Use. Unauthorized Service use is prohibited and may result in license termination.
15. User Materials
You agree not to provide User Materials that are false, defamatory, or infringe on others' rights. Psycle Health may use de-identified information for research or analytics purposes.
16. Disclaimer of Warranties
Psycle Health provides the Services “as is” and “as available,” without any warranties of any kind. Psycle Health does not guarantee that Services will be error-free or uninterrupted.
17. Limitation of Liability
Psycle Health is not liable for indirect, incidental, or consequential damages from Service use. Our maximum liability to you is limited to $300.
18. Indemnification
You agree to indemnify and hold Psycle Health harmless from claims arising from your Service use or breach of these Terms of Use.
19. Arbitration Agreement
You and Psycle Health agree to resolve disputes through binding arbitration rather than court. This includes waiving participation rights in class actions. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
20. Patient Responsibility
You are financially responsible for all charges incurred for services rendered by Psycle Health and its affiliated providers. Insurance confirmation does not guarantee payment, and users remain responsible for unpaid balances.
